These terms govern your use of the Enhanced Business Systems website at enhancedfund.com and the client area hosted on it. Enhanced Business Systems is the trade name of EBS Software LLC, a New York limited liability company.
By using this website or the client area, you agree to these terms.
What these terms do not cover
Your license to the Enhanced Fund Accounting software is separate from these terms. That license is governed by the agreement under which your municipality acquired the software, and nothing here modifies, replaces, or limits it. Your annual support and licensing arrangement is likewise governed by its own terms.
If anything in these terms appears to conflict with your software license or support agreement, that agreement controls.
Who may use the client area
The client area is available to employees and authorized representatives of organizations with a current support and licensing agreement with us.
Accounts are issued to named individuals. Sign-in credentials are personal to you and should not be shared, including with colleagues at your own organization. If someone else at your municipality needs access, ask us and we will create an account for them.
Tell us promptly if you believe someone has used your account without authorization, or if a person with an account leaves your organization.
We may suspend or remove access to the client area at our discretion, including where an account appears compromised or where a support agreement has lapsed.
Documentation and materials
Documentation, quick step guides, instructional materials, and support articles in the client area are provided for use by your organization in connection with your licensed use of the software.
You may print and circulate them internally. Please do not publish them publicly, share them with organizations that are not licensed users, or use them to build a competing product.
Acceptable use
Do not use this website or the client area to:
- Gain unauthorized access to any account, system, or data
- Interfere with the operation of the site or the client area
- Scrape, harvest, or bulk-download content by automated means
- Upload malicious code
- Submit anything unlawful, or anything you do not have the right to submit
Intellectual property
The software, this website, our documentation, the Enhanced Business Systems and Enhanced Fund Accounting names, and our logos are owned by us or licensed to us. Nothing on this site grants you any right to them beyond the license you already hold.
Support requests
Support requests submitted through the client area are handled during our normal business hours. We do not commit to a specific response time through these terms. Any service commitments live in your support agreement.
Do not include Social Security numbers, bank account numbers, or similar sensitive personal information in a support request. If we need something like that to resolve an issue, we will arrange a secure way to receive it.
Accuracy and professional responsibility
We work hard to keep our software and our materials current with the New York State Uniform System of Accounts and related requirements, and it is a central part of what we do.
That said, information on this website and in our documentation is provided for general guidance. It is not accounting, auditing, tax, or legal advice. Your organization remains responsible for its own financial reporting, its filings with the Office of the State Comptroller, and its compliance with applicable law. Use of our software does not transfer that responsibility to us.
If you are unsure how a requirement applies to your municipality, consult your auditor, your attorney, or the Office of the State Comptroller.
Website availability
We provide this website and the client area as they are. We do not guarantee that they will be available without interruption or free of errors. We may change or discontinue features at any time.
Limitation of liability
To the fullest extent permitted by New York law, our liability arising out of your use of this website or the client area is limited to the amount you paid us for support and licensing in the twelve months before the claim arose.
We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data arising out of your use of this website or the client area.
This section applies to the website and the client area. Liability relating to the software itself is addressed in your license and support agreement.
Third-party links
This site may link to third-party websites, including the Office of the State Comptroller and other public resources. We do not control them and are not responsible for their content.
Governing law
These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Albany County, New York, and you agree to jurisdiction there.
Changes
We may update these terms. Changes take effect when posted, and the effective date above will be updated. Material changes affecting client area users will be communicated directly.
